TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAFETYBITS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, BE FREE FROM DEFECTS, SECURITY VULNERABILITIES, OR INTERRUPTIONS, OR THAT ANY ERRORS WILL BE CORRECTED. YOU ACKNOWLEDGE THAT YOUR USE OF SAFETYBITS’S SERVICES IS AT YOUR SOLE RISK.

WHILE SAFETYBITS IMPLEMENTS INDUSTRY-STANDARD SECURITY MEASURES TO PROTECT USER DATA, WE DO NOT GUARANTEE THAT UNAUTHORIZED ACCESS, DATA LOSS, OR OTHER SECURITY BREACHES WILL NEVER OCCUR. YOU ARE RESPONSIBLE FOR IMPLEMENTING ADDITIONAL SECURITY CONTROLS AND BACKUPS WHERE NECESSARY.

SAFETYBITS MAY INTEGRATE OR RELY ON THIRD-PARTY SERVICES, PROVIDERS, OR CLOUD INFRASTRUCTURE. YOU ACKNOWLEDGE THAT DEPLOYMENT SUCCESS, AND OPERATIONAL EFFICIENCY DEPEND ON VARIOUS FACTORS, INCLUDING YOUR CONFIGURATION, AND EXTERNAL CONDITIONS BEYOND SAFETYBITS’S CONTROL.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFETYBITS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF SAFETYBITS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 Cap on Liability

SAFETYBITS’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OF SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SAFETYBITS FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS TO SAFETYBITS, OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED (100) EUR OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

8.3 No Liability for Third-Party Services

SAFETYBITS INTEGRATES WITH THIRD-PARTY PROVIDERS (E.G., CLOUD INFRASTRUCTURE, DATABASES, REGISTRIES), BUT WE DO NOT CONTROL, OWN, OR ASSUME LIABILITY FOR THEIR SERVICES. ANY FAILURES, DOWNTIME, SECURITY BREACHES, OR LOSSES CAUSED BY THIRD-PARTY SERVICES ARE SOLELY THE RESPONSIBILITY OF THE RESPECTIVE PROVIDER, AND SAFETYBITS DISCLAIMS ANY RELATED LIABILITY.

8.4 Beta Services Exclusion

BETA SERVICES ARE PROVIDED AS-IS, WITHOUT WARRANTIES, AND SAFETYBITS ASSUMES NO LIABILITY FOR THEIR USE.

10. Termination of Service

You may terminate your Safetybits account and stop using our Services at any time by following the account cancellation procedures outlined in your account settings or by contacting our support team. Termination does not relieve you of any outstanding payment obligations or other liabilities incurred prior to termination.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the Services, or any other aspect of the relationship between you and Safetybits, the parties agree to make good faith efforts to resolve the matter informally and amicably.

If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of Zaragoza, Spain. You agree to submit to the personal jurisdiction of these courts and waive any objection to venue or inconvenient forum.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR SIMILAR PROCEEDING AGAINST SAFETYBITS.
